V. SMOKING
A. Smoking is prohibited everywhere indoors and outdoors on or in the
Condominium property, except within the interior confines of units and in
designated outdoor smoking areas to be determined by the Board, subject to
use restrictions and nuisance prohibitions in the Governing Documents. By
way of illustration and not limitation, smoking is prohibited on all ocean side
balconies connected to units, Coastal Highway side walkways and balconies,
all pool and sun decks, garages, restaurants, bars, restrooms, and the lobby.
B. For purposes of this Rule and Regulation, smoking shall include but not
be limited to: (i) Any practice by which any substance (including, but not
limited to, cannabis, nicotine, or any other substance) is burned and the
resulting smoke is breathed in to be tasted or inhaled and/or subsequently
exhaled; (ii) the carrying or use of any cigarette, rolled cigarette, pipe, cigar,
bidi, hookah, vape pen, bong or any other device or implement designed or
intended to be used to burn, consume or transform any substance for the
purpose of creating smoke that is breathed in to be tasted or inhaled and/or
subsequently exhaled. Nothing herein shall be construed to permit any
conduct that is otherwise prohibited by applicable federal, state, county, or
municipal law. Notwithstanding the foregoing, for purposes of this Rule and
Regulation, “smoking” shall not include the lawful consumption of cannabis
or nicotine products in edible, tincture, or other products that do not emit

C. Smoking within the interior confines of units shall not occur with any
windows or doors open, and shall not interfere with the use, comfort, or

modifications to their units to prevent smoke and odors from entering into or
affecting other units, Common Elements, or Limited Common Elements.
Such modifications may include, but are not limited to, the purchase and
operation of air scrubbers and purifiers, the sealing and caulking of any and
all gaps around plumbing, lighting fixtures, doors, windows, or drywall
protrusions that would allow smoke to travel to other units, Common
Elements, or Limited Common Elements, and/or other measures to prevent
smoke and odors from escaping the interior of the unit through exhaust,
ventilation, or HVAC systems. This Rule and Regulation does not impact the
use restrictions contained in the Bylaws, which remain fully enforceable
despite the existence of this Rule. In other words, smoking in units is not
allowed if it violates any use restriction or provision of the Bylaws.
D. Owners who rent their units shall include in their lease agreements
provisions that: require tenants to abide by the Condominium’s Governing
Documents and these and any other Rules of the Condominium; make tenants
liable for violations thereof; and, authorize the Condominium to take action
to terminate the lease on account of such violations, in addition to any other
remedies the Condominium might have or pursue. Unit Owners may be held
responsible for acts or omissions of their guests that constitute violations of
the provisions of this Resolution.

reasons. Please be certain all such doors are secured behind you. Do not

H. No carpet or floor covering is allowed to be installed on a balcony by
an owner on the ocean or the bay side.
VII. RENTAL REGISTRATION AND OCCUPANCY FEE
A. No occupancy or use of a unit by a Tenant (as defined in the Bylaws)
(“Rental”) shall be permitted unless the registration requirements set forth in
these Rules and Regulations have been satisfied and all applicable Rental
Registration and Occupancy Fees and other charges established pursuant to
these Rules and Regulations have been paid in full. Failure to comply with this
Rule may be grounds for enforcement as provided for by the Condominium’s
Declaration, Bylaws, the Maryland Condominium Act, other Maryland law,
and these Rules and Regulations.
B. Owners shall be responsible for ensuring compliance by their renters with
all registration requirements set forth in these Rules and Regulations.
C. The Rental Registration and Occupancy Fee shall be paid by the Tenant
as a condition of rental occupancy within the Condominium from May 1 to
September 30. The Rental Registration and Occupancy Fee may be collected
directly from the Tenant by the Condominium or by any person or entity
authorized by the Condominium to collect such fee. Pursuant to Article I, § 2
and Article VIII, § 4 of the Bylaws, the Owner shall remain jointly responsible
for the Tenant’s compliance with these Rules and Regulations, including the
Tenant’s obligation to pay all Rental Registration and Occupancy Fees,
charges, and other amounts imposed pursuant to these Rules and Regulations.
The Condominium may collect and enforce all amounts due pursuant to these
Rules and Regulations in the same manner as other charges due to the
Condominium under the Governing Documents and applicable law. Failure
to comply with any provision of these Rules and Regulations shall constitute
a violation of the Governing Documents and may be enforced by the
Condominium through any remedy available under the Governing Documents
or applicable law, including, without limitation, the imposition of sanctions, the
suspension of privileges, the commencement of legal proceedings, the recovery
of damages, the recovery of attorneys' fees and costs to the extent permitted by
the Governing Documents or applicable law, the imposition of a lien, and the
obtaining of injunctive or other equitable relief. The remedies available to the
Condominium under these Rules and Regulations, the Governing Documents,
and applicable law shall be cumulative and not exclusive. Nothing in this
Section authorizes the suspension of a Unit Owner’s appurtenant rights in the
Common Elements beyond those authorized in the Bylaws.
D. A Rental Registration and Occupancy Fee in the amount of Eighty Dollars
($80.00) per Rental shall be paid upon arrival. A rental lasting longer than a
week must pay additional Registration and Occupancy Fees for each additional
or partial week.
E. The Rental Registration and Occupancy Fee is imposed in connection
with Rental occupancy of units within the Condominium. The Fee is associated
with Rental registration, occupancy administration, parking privileges,
occupancy-related services, and the administration, operation, regulation, use,
and enjoyment of Condominium facilities, amenities, services, Common
Elements, and occupancy privileges by non-owner occupants, as well as
offsetting of the costs incurred by the Condominium to address administrative,
operational, parking, occupancy-management, facility, infrastructure, and
Common Element impacts associated with Rental occupancy. For purposes of
this Section, the parking privileges and Common Element use associated with
the Rental Registration and Occupancy Fee do not include the use, rental, or
operation of any Limited Common Element.
F. Payment of the Rental Registration and Occupancy Fee shall entitle the
Tenant to the rights, privileges, services, and benefits associated with Rental
occupancy of a unit in the Condominium, as provided for and subject to these
Rules and Regulations and the Declaration, Bylaws, policies, and procedures
of the Condominium, as amended from time to time.
G. The Rental Registration and Occupancy Fee shall be payable in full
regardless of the degree to which the Tenant elects to utilize all privileges,
facilities, amenities, services, or occupancy privileges to which the Tenant is
entitled.
H. A registered Tenant may be issued up to two (2) parking permits, valid
only for one week so long as the Tenant’s occupancy under a written lease is in
place. One permit may identify the vehicle authorized to use the parking space
assigned to the rented Unit, the right to use which derives from the Unit Owner
and the lease and not from payment of the Rental Registration and Occupancy
Fee. The second permit may authorize use of one available unassigned parking
space, subject to availability and the Governing Documents. No portion of the
Rental Registration and Occupancy Fee is imposed for the use, rental, or
operation of any Limited Common Element. All parking upon the
Condominium property shall be in accordance with the Condominium’s
Governing Documents (i.e., Declaration, Bylaws and Rules and Regulations).
I. All vehicles utilizing parking privileges pursuant to these Rules and
Regulations shall be compliant with the Governing Documents and shall
display such permit, decal, tag, registration, or other identification as the
Condominium may issue and/or require from time to time. Parking permits
issued are non-transferable and may be used only by the Tenant and occupants
of the unit for which the permits are issued and only for the duration of the
Tenant’s occupancy of the unit pursuant to a written lease.
J. The Condominium reserves the right to establish additional procedures
governing the issuance, use, replacement, suspension, or revocation of parking
permits, and to modify parking assignments in accordance with the Governing
Documents, if and when reasonably necessary for the operation and
management of the Condominium.
K. Additional parking permits may be made available when parking spaces
are available, as determined by the Condominium. In addition to the Rental
Registration and Occupancy Fee, the fee for additional parking permits, if
available, shall be Ten Dollars ($10.00) per day.
L. As a condition of Rental occupancy, the owner and Tenant shall provide
the information and documentation set forth below, as well as any such
additional information and documentation as the Condominium may reasonably
require:
(i) the name, address, telephone number, and electronic mail address of
the Owner;
(ii) the name, address, telephone number, and electronic mail address of
the Tenant and other Occupants;
(iii) the address of the Rental Unit;
(iv) the commencement date and expiration date of the Rental;
(v) vehicle information for all vehicles for which parking privileges are
requested;
(vi) emergency contact information;
(vii) a copy of the lease or rental agreement, or such portions thereof as
the Condominium may reasonably require; and
(viii) such other information and documentation as the Board may
reasonably require from time to time.
